What a court-confirmed sale is

A court-confirmed sale is a probate sale of real property that the probate court has to approve. It generally applies when the executor or administrator has limited authority, or does not have authority under the Independent Administration of Estates Act (IAEA). The offer is accepted subject to confirmation, the attorney of record petitions the court, and at the hearing the court either confirms the sale or accepts a higher bid from another buyer, called an overbid.

Probate for a Los Angeles County or Orange County decedent runs through the Superior Court of the county where the person lived. How the sale is approved depends on the authority the court granted:

Approval stepFull IAEA authorityLimited authority or court confirmation
How the sale is approvedNotice of Proposed Action to heirs, who have at least 15 days to objectA court hearing to confirm the sale
Can other buyers overbid?NoYes, at the confirmation hearing

The attorney of record determines which applies. We follow that direction.

Timeline: where the time goes

These are the stages of a court-confirmed sale. The attorney of record controls the court calendar and notice schedule, and we handle the property side.

  1. Authority confirmed. Letters are issued and the attorney of record confirms what authority the executor or administrator has. We do not start cleanout or renovation until authority is confirmed.
  2. Assessment and prep. We walk the property within 2 to 3 business days of referral and deliver a written assessment shortly after. Prep takes 1 to 2 weeks of cleanup for an as-is listing, or 4 to 8 weeks for a renovation.
  3. Listing and offer. The home is listed and an offer is accepted subject to court confirmation.
  4. Petition and hearing. The attorney of record files the petition for confirmation. The hearing date depends on the court’s calendar and the required notice period.
  5. Confirmation and overbids. At the hearing the court confirms the sale or accepts higher bids in open court. We stay in contact with your office so the estate is ready if that happens.
  6. Closing. After the court confirms the sale, escrow closes and we deliver the closing package to your office.

Probate as a whole commonly runs a year or more from filing to final distribution, and a court-confirmed sale adds a hearing to that process.

Disclosure and documentation points to settle early

Which disclosure forms and sale terms apply is a question for the attorney of record. These are the points attorneys raise most, and what we do on our side:

  • Who signsThe letters or trust documents control who can approve work and sign sale documents. We work from your direction on that.
  • What was known about the homeFiduciaries often have limited first-hand knowledge of the property. Our written assessment documents condition, photos, and identified issues, dated, so the file shows what was known and when.
  • The disclosure packageWe assemble the condition documentation from our assessment, plus any permit records and reports available, so the package is ready when an offer is accepted.
  • Commission and costsThe commission and sale terms are subject to the court’s approval at confirmation. Costs we front are itemized and documented so your office has what it needs for the file.

What to send with a referral

A call or email with the address is enough to start. Send the rest as you have it:

  • Property addressPlus access details: who has keys, and whether the home is occupied or vacant.
  • AuthorityLetters testamentary (or letters of administration) or the trust documents, and whether full IAEA authority was requested or granted.
  • Beneficiary situationHow many beneficiaries there are, whether they agree on a plan, and who the point of contact is for the family.
  • Property conditionWhat you know: deferred maintenance, vacancy, tenants or occupants, and personal property still in the home.
  • Court deadlinesHearing dates, petition deadlines, or any other date that affects when the home must be listed or sold.

How the assessment works

After a referral we follow up with you and the family or trustee within one business day. A property walk typically happens within 2 to 3 business days of referral, and a written assessment follows shortly after. It covers the condition of the home, a documented photo record, and the three options (as-is listing, renovate and sell, or cash close) with a projected net for each, so the decision is made on numbers.

Common questions about court-confirmed sales

How long does a court-confirmed probate sale take in Los Angeles or Orange County?

It depends on the court's calendar and notice period, so ask the attorney of record for the hearing date. On the property side, expect 1 to 2 weeks of cleanup for an as-is listing or 4 to 8 weeks of prep for a renovation before the home is listed, then the offer, the petition, and the hearing. Probate as a whole commonly runs a year or more from filing to final distribution.

Can someone overbid after the seller accepts an offer?

Yes, in a court-confirmed sale. The accepted offer is subject to court confirmation, and at the hearing the court either confirms the sale or accepts a higher bid from another buyer. With full IAEA authority the sale proceeds on a Notice of Proposed Action instead, and other buyers cannot overbid.

Does an executor always need court confirmation to sell a house in probate?

No. With full authority under the Independent Administration of Estates Act (IAEA), the sale can usually proceed by giving heirs a Notice of Proposed Action, and they have at least 15 days to object. With limited authority, or without IAEA authority, the sale generally needs court confirmation. The attorney of record determines which applies.

Can the house be cleaned out or renovated before the court confirms the sale?

Work should start only after the attorney of record confirms that the executor or administrator has authority to approve it. Once authority is confirmed, we front the cleanout and renovation costs and are reimbursed at closing, and we document every cost for the file.

What should an attorney send with a probate sale referral?

The property address and access details, the letters testamentary (or letters of administration) or trust documents, the beneficiary situation, what you know about the property's condition, and any court deadlines. A call or email with the address is enough to start.

How quickly can you assess a property after a referral in Los Angeles or Orange County?

We typically schedule a property walk within 2 to 3 business days of referral and deliver a written assessment shortly after.
